#Service Agreement

1. General

BY USING AND/OR VISITING THE WWW.WEBXCES.COM WEBSITE AND/OR ANY SUB-WEBSITE OF WWW.WEBXCES.COM (as defined below; collectively, including all content available through the WEBXCES.com domain name and/or any sub-domain name such as www.mobile.WEBXCES.com, the "WEBXCES Website", or "Website"), is owned, maintained and operated by WEBXCES. and by USING ANY OF THE SERVICES PROVIDED ON THE WEBSITE (as defined bellow) YOU SIGNIFY YOUR ASSENT TO BOTH THESE ("Use Policy" And "Service Agreement"), WHICH ARE PUBLISHED AT http://www.webxces.com, AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. If you do not agree to any of these terms, then please do not use the Website or any other product associated with WEBXCES
WEBXCES shall have the right, at its sole discretion, to modify, add or remove any terms or conditions, Service Agreement or Use Policy without notice or liability to you. Any changes to these Terms will be apply Instantly following the content of such changes on this website.
This Service Level Agreement is applicable to you if you have purchased any services including websites, domain services, shared hosting services, VPS dedicated servers, or any outlined service provided by us on WEBXCES website or any sources "Service" and you are in good financial standing with WEBXCES.
You agree to review these Terms of Use and Service agreement from time to time and agree that any subsequent use by you of this web site following changes to these Terms of Use shall compose your acceptance of all such changes.

• Account or Service will registered under customer (His / her) personal / Commercial Email Address (as registered email address)
• For all service, WEBXCES Coordinates to/from registered mail address. In case we receive mail from non-registered mail id, WEBXCES won't be able to assist.
• In case, one want to know his / her registered mail address can send mail at support@webxces.com with project name or website domain name, or other details we shall response by verifying.

2. Licenses

WEBXCES hereby grants you a non-exclusive, non-transferable, worldwide right to use the Product or Service, solely for your own business intention, subject to the terms and conditions of this Agreement.
All rights not expressly granted to you are reserved by WEBXCES. You are not allowed: reverse engineer, decompile, disassemble, or attempt to discover the source code, object code, or basic structure, ideas, or algorithms of, or found at or through the Service or any software or application, documentation, data related to the Service; remove any proprietary notices or labels from the Service, modify, translate, or create Plagiarized works based on the Service or Pirate, distribute, pledge, assign, or otherwise transfer or encumber rights to the Service.
WEBXCES Product and services License/rights are subject to paid invoice form webxces for particular product or services mentioned in invoice, License/right shall be renewed periodically.
Strictly not allowed for duplicate, decompile, disassemble attempt to discover the source code, object code, or basic structure, ideas, or algorithms

3. Rights

WEBXCES explicitly reserves the right and sole discretion to:

• Modify its pricing, if desired by WEBXCES from time to time
• Establish guidelines and limits concerning the use of the services
• Terminate Your use of services for use of our services to unnecessarily/illegally harass WEBXCES or third parties, non-payment of fees for our services, activities designed to embarrass, defame, harm, threaten, mistreat, slander / stalk third parties, activities prohibited by the laws of India and / or foreign countries in which you conduct business, activities designed to encourage unlawful behavior by others, such as child pornography, terrorism, hate crimes activities that are tortious, obscene, vulgar, invasive of the privacy of a third party, ethnically, racially, or otherwise objectionable in the sole opinion of WEBXCES or declared by the law of land, activities designed to harm minors in any way, activities designed to impersonate the identity of a third party, and other activities whether lawful/unlawful that WEBXCES determines, in its sole circumspection, to be harmful to its other customers, reputation or operations
• Terminate Your services provided if your use of services results in, or is the subject of, legal action or threatened or proposed legal action, against WEBXCES or any of its affiliates/partners
• Terminate your services provided at any time and for any reason if deemed reasonably necessary by WEBXCES.

4. Security

• You are solely responsible for any misuse of your any account, even if the inappropriate activity was committed by a family member, guest, friend, or your employee. Therefore, you must take appropriate steps to ensure that nobody can gain unauthorized access to your account. Also, you may not use your account to break the security of another account or try to gain unauthorized access to another network or server.
• Your password grants access to your account. We are not responsible for your password security.
• Sharing your account access and passwords with unauthorized users is prohibited. You should take care to stop others from using your account since you will be held responsible for such use.
• Services will terminate, if Your use of services results in, or is the subject of, legal action or threatened or proposed legal action, Against Company or any of its affiliates / partners.
• You must adopt security measures to prevent unauthorized use of your account.

Trying to obtain another user’s account password is strictly prohibited, and may result in termination of service. You may not try to ruin user authentication or security of any host, account or network. This includes, unlimited to, accessing data not intended for you, logging into or using of a server or account you are not purposefully authorized to access, or probing the security of other networks. Use or distribution of tools designed for keeping security at risk is prohibited.

Examples of all these tools include, however are unlimited to cracking tools, password guessing programs or network probing tools. You may not allowed to interfere with service to any host, user or network ("denial of service attacks"). This includes, but is unlimited to, "flooding" of networks, attempts to "crash" a host and deliberate attempts to overload a service. Users who put network or systems security at risk may incur civil or criminal civil liability. WEBXCES shall cooperate with law enforcement authorities in the investigation of infringement of network or system security at other websites, including investigation of suspected criminal infringement.

5. Availability of Services

Subject to the terms and conditions of this agreement WEBXCES shall try its level best to offer the dedicated services throughout the term of this Agreement. You, however agree that the services may be inaccessible/ inoperable for any reason, including, without any limitation:

• Equipment malfunctions;
• Causes beyond the control of WEBXCES or that are not reasonably foreseeable by WEBXCES, including, without limitation, failure or interruption of telecommunication or digital transmission links, network congestion, hostile network attacks or other failures;
• Periodic repair procedures or maintenance that WEBXCES may undertake from time to time.

You agree WEBXCES has no control of availability of services on a continuous and/ or uninterrupted basis.
You further agree that as a normal course of its business, it may be really necessary for WEBXCES to migrate its servers. As a result, even though you may have a dedicated IP or Name Servers, You may be assigned a different IP number or Name Server. WEBXCES does not warrant that you will be able to consistently maintain your allotted IP numbers or Name Servers.
WEBXCES offers a service uptime of 99.9% (“Service Uptime”) of available time. If WEBXCES fails to maintain this level of service availability, you may contact WEBXCES for further follow up for that month.
The credit may be used only for the purchase of further services and products from WEBXCES, (excluding applicable taxes), this service is not available for our domain and hosting packages. The credits does not apply to service interruptions caused by:

• Errors caused by your end from custom coding or scripting, at your end; or
• Causes beyond control of WEBXCES or that are not reasonably foreseeable by WEBXCES; or
• Periodic scheduled repairs or maintenance WEBXCES may undertake from time to time; and
• Outages not affected the appearance of the website but simply affect access to the site such as email and FTP; or
• Outages related to reliability of programming environments.

6. FTP Backup

You agree and acknowledge that the FTP Backup services may be inoperable or inaccessible for any reason, including without any limitations whatsoever:

• Periodic repairs or maintenance procedures that WEBXCES may undertake from time to time,
• Equipment mal-functioning’s
• Causes beyond control of WEBXCES or that are not reasonably foreseeable by WEBXCES, including, without limitation, failure, interruption of digital transmission or telecommunication links, network congestion, hostile network attacks, or other failures.

7. Identification Information

• You agree as a person legally responsible for use of account are at least 18 years of age.
• You agree to supply WEBXCES with a current and truthful name, postal address and telephone number for our records, and you have a continued obligation to keep this information current.

8. Limitations

Online issues and problems occur constantly. There might be occasions when you are unable to access your website or any other service. This is not necessarily due to WEBXCES. Possibly your Internet Services Provider (ISP) is experiencing technical difficulties, or there might be a routing problem between your ISP and WEBXCES, making communication difficult or even impossible. We cannot bear the responsibility of such problems and are not at all liable to lend ourselves to redress of any sort.
